MoC warns of strict legal action against promoting fake products
The Ministry of Commerce has issued a proclamation stating that strict legal action shall be initiated against those who promote to sell products, goods and services that contain false commercial descriptions.
In a statement signed by Cham Nimul, Minister of Commerce and Chairperson of the National Committee for Consumer Protection and circulated on Tuesday to businesses related to advertising and promotion of products and services, the statement identified some unfair practices in business that are not covered by the consumer protection law in relation to advertising and sale promotion to protect the rights and interests of consumers.
This also applies to individuals engaged in the business of supplying and promoting products, goods and services through false or misleading promises and advertisements including digital means in Cambodia.
Advertising to sell products and services is a strategy to promote sales, but some businessmen do not act honestly in line with the law, the ministry stated.
“Perpetrators are subject to penalties under the Consumer Protection Law,” stated the ministry.
The ministry asked individual businessmen to provide business information and relevant documents required by the Director General of Consumer Protection, Competition and Fraud Repression ‘CCF’.
CCF Director General Phan Oun has previously said CCF has always met with companies doing business in Cambodia to promote consumer protection and be cautious of their advertisements that can be misleading and cheat consumers.
CCF has found some businesses’ products were still in violation of the law, which required further enforcement to ensure that no advertisements were misleading, lured customers and confused users, Oun said.
To prevent the traffic of defective and out-of-date goods, ensure fair business in the market, ensure the welfare of the people and protect the interests of consumers, CCF continues to inspect all kinds of goods in the market, warehousing and marts, he said.
Consumer Protection Competition and Fraud Repression Directorate-General (CCF) is tasked to ensure the quality and safety of products and services and people’s health.
The country’s Law on Consumer Protection (Consumer Protection Law) was enacted in November 2019. The new law changes the legal landscape in important ways for businesses under its purview.
Additionally, the ministry stated that individuals doing business supplying products and services must label price tags in KHR on all products, goods and services displayed in supermarkets and marts.
