US DOC initiates anti-dumping investigation into Vietnam yarn
The U.S. Department of Commerce (DOC) has initiated an anti-dumping investigation into polyester textured yarn (PTY) imported from Vietnam and three other countries, according to the Trade Remedies Authority of Vietnam under the Ministry of Industry and Trade.
The three other nations are Indonesia, Malaysia, and Thailand.
The petitions were filed by Nan Ya Plastics Corporation in South Carolina and Unifi Manufacturing, Inc. in North Carolina, the International Trade Administration under the U.S. DOC said in a press release on November 18.
The alleged anti-dumping duty margin for Vietnamese products is 54.13 percent.
If the U.S. DOC makes affirmative findings in the investigation, and if the U.S. International Trade Commission (ITC) determines that dumped polyester textured yarn from Vietnam materially injured or threatened material injury to the U.S. industry, the DOC will impose duties on the Southeast Asian country’s imports in the amount of dumping found to exist.
During the DOC’s anti-dumping duty investigation of polyester textured yarn from Vietnam, the ITC will conduct its own probe into whether the imports injure or threaten to injure the U.S. industry and its workforce.
The ITC will make its preliminary determinations on or before December 14, 2020.
If the ITC preliminarily determines that there is a reasonable indication of material injury or threat of material injury to the domestic industry, then the DOC’s investigation will continue, with the preliminary determination scheduled for April 6, 2021. This deadline may be extended.
If the DOC preliminarily determines that dumping is occurring, then it will instruct U.S. Customs and Border Protection to start collecting cash deposits from all U.S. companies importing polyester textured yarn from Vietnam, as appropriate.
Final determination by the DOC in the case is scheduled for June 21, 2021, although these deadlines may be extended.
If the DOC finds that products are not being dumped, or the ITC finds in its final determination there is no injury to the U.S. industry, then the investigation will be terminated, and no duties will be applied.
In 2019, polyester textured yarn imports from Vietnam into the U.S. were valued at US$4.5 million, according to ITA.
