Developer, authorities found responsible for multiple violations at resort projects in Vietnam

A series of violations have been detected at two major resorts in central Vietnam, exposing the responsibility of the project developer and local authorities.

 

The Ministry of Construction Inspectorate have finalized their inspection of two resort projects developed by FLC Group in Sam Son, a city in the north-central province of Thanh Hoa, and Quy Nhon City, located in the south-central province of Binh Dinh.

Several offenses have been exposed, with both FLC and authorities in the two provinces to blame.

In Thanh Hoa, the provincial People’s Committee was found approving the construction of a golf course, which was part of the FLC resort in Sam Son, in March 2013, a decision that was made prior to the consent of the prime minister in April 2014.

That the Thanh Hoa administration agreed to the transformation of 11 hectares of forest into a golf course was against the law, according to the inspectorate.

FLC was also allowed to execute its resort project on 11.6 hectares of protection forest without meeting requirements.

Meanwhile, the Thanh Hoa Department of Construction was discovered issuing the building permits for multiple constructions in the project only after the works had been done.

The group was also found completing several other components while lacking formal permission.

At the resort and villa complex in Binh Dinh, about five constructions within the projects have been finished without any building permission from local authorities.

Regarding the responsibility of FLC Group, the developer has failed to show a variety of mandatory documents for the execution and operation of its two projects in Binh Dinh and Thanh Hoa.

In Sam Son, the firm put into operation a seven-story hotel and started the construction of another hotel and some facilities of the golf course without any building license.

A similar violation was also recorded for gold course, villa, and entertainment areas at the project in Quy Nhon.

Solutions

The Ministry of Construction Inspectorate have ordered the People’s Committees in Thanh Hoa and Binh Dinh to hold those whose managerial oversight had led to the violations accountable.

FLC was also requested to cease the construction of its illegitimate projects to fulfill necessary paperwork regarding building permits.

Nguyen Ngoc Tuan, chief inspector from the construction ministry, told Tuoi Tre (Youth) newspaper on Saturday that FLC would have to finalize the administrative procedures or have its illegal constructions dismantled, depending on the severity of its offenses.

Local officials whose lack of responsibility allowed the violations to happen would be disciplined as per the law, Tuan added.

All parties involved in the multiple offenses will have to prepare a report of their solutions to all the problems by September 16, 2017.

A representative from FLC stated that the firm had agreed to the results of the inspection.

The company has completed the necessary paperwork and submitted it to competent agencies, the representative claimed.
